If you have fallen behind in your mortgage payments and your mortgage lender is threatening or has started a foreclosure proceeding, then you need to be aware that this process can move fairly quickly. Georgia is a “non-judicial” foreclosure State which means that the creditor does not need to file a lawsuit to proceed with a foreclosure. The creditor must simply advertise for four weeks prior to the scheduled sale date, give you 30 days certified notice prior to the sale date and then simply auction the house on the courthouse steps on the scheduled foreclosure day.
